Understanding the Illinois Acts Life Care Program for Senior Living

In 1982, Illinois introduced the Illinois Life Care Facilities Act to address growing concerns about the financial health of facilities offering long-term care and housing for seniors. This legislation, officially known as 210 ILCS 40/, empowers the Illinois Department of Public Health to oversee residency agreements, termed Life Care Contracts. These contracts are defined by an upfront entrance fee alongside provisions for personal, nursing, or medical care, in conjunction with residency arrangements.

The Illinois Department of Public Health diligently regulates these facilities through the Life Care Facilities Act and its accompanying Illinois Life Care Facilities Contract Code (77 Ill. Adm. Code 396). This regulatory framework enables the Department to grant permits to facilities, authorizing them to enter into Life Care Contracts. Furthermore, the Department is responsible for continuous monitoring to ensure these facilities adhere to both the Act and the Code, safeguarding the interests of residents.

Currently, around 90 facilities or campus communities across Illinois hold permits to offer and execute Life Care Contracts, as issued by the Department. Collectively, these communities provide over 23,000 living units under life care contracts, predominantly situated within the Chicago metropolitan area.
